1. Agreement to Terms

By accessing and using Nearbi ("App"), a gay hookup and dating platform, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on Nearbi for personal, non-commercial transitory viewing only. Under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose or for any public display
• Attempt to decompile or reverse engineer any software contained on the App
• Remove any copyright or other proprietary notations from the materials

3. User Accounts

3.1 Account Creation

To use Nearbi, you must:

• Be at least 18 years old
• Provide accurate and complete information
• Complete photo verification to confirm your identity
• Maintain the security of your password
• Not share your account credentials

3.2 Account Responsibility

You are responsible for all activity on your account. Notify us immediately of any unauthorized access or use.

3.3 Account Termination

We reserve the right to terminate accounts that violate these Terms, engage in abusive or illegal behavior, or repeatedly violate Community Guidelines.

4. User Content

4.1 Your Responsibilities

You are responsible for all content you post to Nearbi, including photos, videos, messages, and profile information.

4.2 Prohibited Content

You may not post content that is:

• Illegal or promotes illegal activity
• Contains hate speech or discrimination
• Sexually explicit pornography (adult content is acceptable, but not hardcore pornography)
• Violates intellectual property rights
• Spam, phishing, or fraudulent
• Impersonates another person
• Promotes commercial services without proper creator account setup

4.3 Creator Content

If you use Nearbi's creator tools to link external platforms (OnlyFans, tip jars, etc.):

• You must comply with those platforms' terms of service
• You are responsible for all external transactions and content
• Nearbi is not liable for creator-user interactions or transactions
• Creator accounts may be subject to additional verification

5. Community Guidelines

5.1 Respectful Behavior

Users agree to treat other users with respect and follow all applicable laws.

5.2 No Harassment

Harassment, bullying, or threatening behavior is strictly prohibited and will result in account suspension or termination.

5.3 Age Requirement

Nearbi is exclusively for users 18 and older. Minors are not permitted.

5.4 Authenticity

Users must represent themselves accurately. Fake accounts, catfishing, and impersonation are prohibited.

6. Photo & Content Moderation

6.1 Photo Requirements

All profile photos must:

• Contain only your face/body
• Not contain hardcore pornography (shirtless/revealing photos are allowed)
• Be your actual appearance
• Not be pictures of other people
• Pass photo verification if requested

6.2 Photo Verification

Photo verification may be required to confirm your identity and prevent catfishing. Verification involves taking a real-time selfie that is compared to your profile photos. Refusing verification may result in account restrictions.

6.3 Adult Content Guidelines

While Nearbi allows adult-oriented connections, we maintain community standards. Shirtless and revealing photos are permitted, but hardcore pornographic images or videos are not allowed as profile content.

7. Reporting & Safety

7.1 Reporting System

Users can report inappropriate behavior, content, or safety concerns in the App.

7.2 Investigation

We investigate all reports and take appropriate action, which may include:

• Warning the user
• Suspending the account
• Permanently banning the user
• Reporting to law enforcement (if illegal)

8. Location Sharing

Your location is used to show nearby users. Your exact location is never shared with other users, only approximate distance.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

Nearbi is provided "as is" without warranties of any kind. In no event shall Nearbi be liable for loss of profits, loss of data, or any indirect or consequential damages arising from your use of or inability to use the App.

10. Termination

10.1 Your Right to Terminate

You can delete your account at any time through the App Settings.

10.2 Our Right to Terminate

We may terminate your account at any time for violation of these Terms, illegal activity, abuse, or harassment.

11. Privacy

Your use of Nearbi is also governed by our Privacy Policy. Please review it to understand our practices.

12. Changes to These Terms

We may update these Terms at any time. Changes become effective when posted in the App. Continued use of Nearbi means acceptance of the updated Terms.

By using Nearbi, you certify that:

• You have not been convicted of crimes involving harm to others
• You are not a registered sex offender
